Recovering Real Estate from Unwanted Occupants: Property Possession Claims & Landlord Tenant Law in Oregon Recovering possession of real estate from unwanted occupants in Oregon can be challenging. This seminar identifies different types of property possession claims involving both tenant and non-tenant occupants. It discusses residential tenancy definitions and exclusions under ORS Chapter 90 and summarizes the Forcible Entry & Detainer (Eviction) process. It explores how Oregon’s “just cause” statutory scheme prohibits most “no cause” terminations of tenancy without a statutorily defined “qualified reason.” Finally, this seminar discusses how voluntary tenancy termination agreements may be used to recover possession of properties, essential agreement terms, and how to negotiate agreements. Learning Objectives:

A person with a disability or an authorized legal representative can open an ABLE account. The money in an ABLE account belongs to the person with the disability and does not count against their means tested asset limits for vital state and federal benefits.
