Recovering Real Estate from Unwanted Occupants: Property Possession Claims & Landlord Tenant Law in Oregon
Presented by Damon Petticord, Petticord Law Group

Recovering possession of real estate from unwanted occupants in Oregon can be challenging. This seminar identifies different types of property possession claims involving both tenant and non-tenant occupants. It discusses residential tenancy definitions and exclusions under ORS Chapter 90 and summarizes the Forcible Entry & Detainer (Eviction) process. It explores how Oregon’s “just cause” statutory scheme prohibits most “no cause” terminations of tenancy without a statutorily defined “qualified reason.” Finally, this seminar discusses how voluntary tenancy termination agreements may be used to recover possession of properties, essential agreement terms, and how to negotiate agreements.

Learning Objectives:

  • Identify different types of property possession claims in Oregon.
  • Residential tenancy definition and exclusions.
  • A brief overview of the forcible entry & detainer.
  • Oregon's "Just Cause" statutory scheme.
  • Voluntary termination agreements.

Meet your Speaker:

Damon Petticord specializes in helping property owners and landlords recover possession of properties from tenants and other occupants. He has assisted hundreds of property owners and landlords across the State of Oregon. He has been member of the Oregon State Bar since 1996 and Washington State Bar since 2002.
